Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Tickerzone Inc. (“TickerZone,” “we,” “us”) governing your use of the TickerZone website and applications (the “Service”). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

2. Not financial advice

TickerZone is an informational tool for tracking and analyzing your own investments. We are not a broker, dealer, investment adviser, or financial institution, and nothing on the Service is financial, tax, legal, or investment advice or a recommendation to buy or sell any security. Market data may be delayed or inaccurate. You are solely responsible for your own investment decisions and should consult a licensed professional before acting.

You are responsible for your account, for keeping your login credentials secure, and for all activity that occurs under your account. You agree to provide accurate information and to notify us of any unauthorized use. When you use the Service, you agree not to:

Paid plans are billed through our payment processor, Stripe. Paid subscriptions renew automatically for the period you selected until you cancel. You can cancel at any time from your account settings; your access continues until the end of the current billing period. Except where required by law, payments are non-refundable. We may change our prices with reasonable notice.

5. Linked accounts

You may choose to connect a brokerage or bank account through our provider, Plaid, so the Service can display your holdings. By connecting an account, you authorize us and Plaid to access that account information on your behalf. You can disconnect a linked account at any time from your account settings.

6. Intellectual property

The Service, including its content, software, and the TickerZone name and logo, is owned by TickerZone and protected by law. We grant you a limited, personal, non-transferable right to use the Service. The data you enter or link remains yours.

7. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. TO THE FULLEST EXTENT PERMITTED BY LAW, TICKERZONE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR $500, WHICHEVER IS LESS.

8. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and dispute resolution) will continue to apply.

9. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the revised Terms.

10. Governing law and dispute resolution

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules.

Except for claims of intellectual property infringement or claims that may be brought in small claims court, any dispute arising out of or relating to these Terms or the Service will be resolved by binding, individual arbitration administered by the American Arbitration Association in Las Vegas, Nevada, under its Commercial Arbitration Rules. YOU AND TICKERZONE WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS OR REPRESENTATIVE ACTION. Any claim must be brought within one year after it arises.
